Solicitud de nulidad en contra del Auto 580/17, mediante el cual se rechazó el recurso de súplica y se confirmó la providencia de rechazo de la demanda de inconstitucionalidad de la referencia.
La Corte considera que el actor pretende controvertir ad infinitum la decisión de rechazo de su demanda y que el uso del incidente de nulidad es estas condiciones resulta desmedido y conlleva un ejercicio abusivo de sus derechos, por lo que, de aceptarse, desnaturalizaría la misma institución de la nulidad, tornaría indefinido el debate sobre la inadmisión y rechazo de una demanda y desconocería los principios y valores constitucionales que precisamente se buscan proteger.
Se RECHAZA, por improcedente.
